The Second Chance Law<\/strong> (Law 25\/2015) allows insolvent individuals and self-employed persons to discharge their debts and get a fresh financial start. IN DIEM Abogados provides comprehensive assistance with the Second Chance procedure throughout Spain. <\/p>\n

Who is it intended for?<\/h2>\n

  • Individuals with debts they cannot pay.<\/li>\n
  • Self-employed individuals with debts to Social Security, the tax authorities, or private creditors.<\/li>\n
  • People who have served as guarantors for loans.<\/li>\n<\/ul>\n

    The Process<\/h2>\n
      \n
    • Phase 1 – Out-of-Court Settlement:<\/strong> Attempt to reach an agreement with creditors through an insolvency mediator.<\/li>\n
    • Phase 2 – Insolvency Proceedings:<\/strong> If no agreement is reached, consecutive insolvency proceedings are filed.<\/li>\n
    • Phase 3 – BEPI:<\/strong> Application for the Benefit of Exemption from Unsatisfied Liabilities, which clears outstanding debts.<\/li>\n<\/ul>\n

      Debts That Can Be Discharged<\/h2>\n

      Through the “Second Chance” program, you can settle debts with banks, credit card companies, personal loan providers, and mortgage lenders (the remaining balance after the property has been surrendered), as well as debts to suppliers and, in certain cases, part of your debts to the tax authorities and Social Security.<\/p>\n
